By accessing the website at https://www.americancanyonepoxyflooringandconcretepolishing.com or by requesting, scheduling, or receiving services from American Canyon Epoxy Flooring & Concrete Polishing ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use this Site or our services.
These terms apply to all visitors to the Site and to all customers who engage the Company for concrete flooring or related contractor services. We reserve the right to update these terms at any time. Continued use of the Site or our services after any update constitutes acceptance of the revised terms.
American Canyon Epoxy Flooring & Concrete Polishing provides concrete flooring contractor services in American Canyon, CA and the surrounding North Bay region. Services include, but are not limited to, epoxy floor coatings, garage floor coatings, polyaspartic coatings, polished concrete, concrete resurfacing, concrete sealing, and related surface preparation and treatment services.
The Company reserves the right to decline any service request at its sole discretion. We do not guarantee availability of specific dates, crews, or products at the time of inquiry.
All estimates provided by the Company are based on an on-site inspection of the work area and represent the Company's good-faith assessment of the scope and cost of the work. Estimates are not binding until a written agreement or contract has been signed by both parties.
Final pricing may be adjusted if, upon commencement of work, the Company discovers conditions that were not visible or disclosed at the time of the estimate - such as hidden moisture problems, structural deficiencies, or concealed damage. Any changes to the agreed price will be communicated to the customer before additional work proceeds.
Free estimates are offered at no obligation. Scheduling an estimate does not obligate you to proceed with any work.
Project start dates are scheduled at the time of contract signing and are subject to crew and materials availability. The Company will make reasonable efforts to honor the scheduled date. However, scheduling may be affected by weather conditions, supply delays, or circumstances beyond the Company's control.
If you need to reschedule or cancel a project, please notify us at least 48 hours before the scheduled start date. Cancellations made less than 48 hours before the start date may result in a cancellation fee if materials have already been ordered or crew has been scheduled specifically for your project.
The Company reserves the right to reschedule work if site conditions on the day of the project are unsuitable for safe or quality application - including but not limited to excessive moisture, temperature extremes, or access restrictions.
Payment terms are specified in the written project agreement. In general, a deposit may be required at the time of scheduling, with the remaining balance due upon completion of the work. Accepted payment methods will be confirmed at the time of agreement.
Failure to make timely payment may result in a delay in project completion or additional charges for collection costs. The Company reserves the right to place a mechanic's lien on the property in the event of non-payment, as permitted by the laws of the State of California.
The customer is responsible for ensuring the work area is accessible and clear of all personal property, vehicles, furniture, and stored items before the scheduled start date. Failure to provide a clear work area may result in a delay or rescheduling fee.
The customer is also responsible for disclosing any known conditions that may affect the project, including prior coatings, known moisture issues, structural repairs, or HOA restrictions that could affect the scope or method of work.
The Company warrants its workmanship against defects arising from installation error for a period specified in the written project agreement. This warranty covers peeling, delamination, or coating failure that results from improper application by the Company's crew.
This warranty does not cover damage caused by misuse, physical impact, chemical exposure beyond normal household or commercial levels, flooding, natural disasters, ground movement including seismic events, or failure of the customer to follow post-installation care instructions provided at the time of project completion.
Product warranties, where applicable, are provided by the manufacturer and are separate from the Company's workmanship warranty.
To the fullest extent permitted by applicable law, the Company's liability to any customer shall be limited to the total amount paid by that customer for the specific project giving rise to the claim. The Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of business, loss of use, or property damage not directly caused by the Company's work.
The Company is not responsible for pre-existing conditions in the concrete, substrate, or structure that were not disclosed at the time of the estimate or that could not reasonably be identified by visual inspection.

In the event of a dispute arising out of or relating to these terms or any project performed by the Company, the parties agree to first attempt to resolve the dispute through good-faith negotiation. If negotiation does not resolve the dispute within 30 days, the parties agree to submit the dispute to mediation before pursuing any other legal remedy.
Any legal action not resolved through mediation shall be filed exclusively in the state or federal courts located in Napa County, California.
These Terms and Conditions and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
